O‘ZGANING YER UCHASTKASIDAN CHEKLANGAN TARZDA FOYDALANISH HUQUQI (SERVITUT): HUQUQIY TAHLIL VA AMALIY MEXANIZMLAR
Abstract
O‘zganing yer uchastkasidan cheklangan tarzda foydalanish huquqi yoki servitut – ko‘chmas mulk egasining qo‘shni yer uchastkasidan, zarur hollarda esa boshqa yer uchastkasidan cheklangan tarzda foydalanish huquqidir. Servitut jismoniy va yuridik shaxslar o‘rtasidagi yer resurslaridan foydalanish munosabatlarini tartibga solishda, nizolarni oldini olishda va jamiyat manfaatlarini muhofaza qilishda muhim ahamiyat kasb etadi. Servitut xususiy va ommaviy bo‘lishi mumkin. Xususiy servitut ikki yoki undan ortiq shaxslar o‘rtasida kelishuv orqali belgilanadi, ommaviy servitut esa jamoat ehtiyojlarini ta’minlash maqsadida davlat organlari qarori bilan joriy etiladi.
